Miami Massage Parlors: Innocent Man to Remain in Prison After Judge Wants More Paperwork

Elroy Phillips will remain in federal prison in Miami while prosecutors and his defense attorney file a joint motion outlining again why they think he should be set free. U.S. District Court Judge Joan A. Lenard demanded the paperwork at a hearing this afternoon in Miami instead of accepting a joint motion to release Phillips.
The new paperwork is yet another legal hurdle for Phillips, who thought he was going to be released two weeks ago when prosecutors finally agreed to drop the charges.
Lenard sentenced Phillips to prison in 2003 after a trial that hinged on the testimony of one West Palm Beach cop. That cop, Michael Ghent, has since given up his license to practice as an officer due to allegations that he shook down a massage parlor and was selling drugs on the side. The FBI, Phillips’ attorney, and prosecutors interviewed Ghent earlier this year, and multiple lies he told helped prosecutors decide that Phillips should be released.

Judge Lenard gave Prosecutors and defense attorney Michael Zelman until May 31st to come up with she called a “joint stipulated” agreement with more details and evidence.
She said she could make a decision before that date if the agreement was submitted at an earlier date.
Zelman told Judge Lenard that the case against unfolded on April 6th, 2001 when former West Palm Beach officer Michael Gent claimed that Phillips had sold “$50 worth of crack cocaine” to an undercover officer.
“We are prepared now to go forward with evidence to show that Gent committed perjury,” said Zelman. Zelman said Gent was convicted of bribery in 2007 for shaking down an illegal massage parlor “that was a house of prostitution.”

Three arrested in prostitution ring
HOLLYWOOD, Fla. (WSVN) — The owner of a massage parlor and two women have been arrested for offering sex for sale.
Orlando Navarette has been arrested and charged with running a prostitution ring and operating a business without a license.
An undercover detective said he was offered oral sex at the Lifescapes Spa along Hollywood Boulevard.
Navarette’s girlfriend and another woman were have also been arrested and charged.

The ordinance, if passed, would ban massage parlors from operating in the commercial entertainment zoning district. Because that is the only area zoned for massage parlors they would effectively be banned from operating within the city.

According to city documents, a few years ago police found that a business that offered massage services was a front for prostitution and closed it down. Documents also allege the city recently turned down an application for a certificate of use by a massage parlor because it was found that the owner’s wife was convicted of prostitution.
Police Chief Kenneth Pachnek said right now his department isn’t having trouble with illegal massage parlors but that legal ones have to be investigated because sometimes unlawful activity can sometimes occur there.

I tried to call three clubs listed on the main South Beach drag of Washington Avenue. One had no phone number I could find, one had a disconnected number and one had only an answering machine with no business name on it.
Prosecutors say at least 88 victims have been identified with total losses in the hundreds of thousands of dollars. One victim was gouged $43,000, the AP reports.
Some of the accused are being held without bail and one top operative is believed to have fled the country, the story said. U.S. Attorney Wifredo Ferrer told the AP that such scams could give “our tourism industry a black eye. We are pleased to have put this ring out of operation.”

The city’s development review board on Thursday reversed a prior ruling that said Rui Nancy Zheng’s $10,000 mural on her All Asian Massage did not fit an adjacent residential neighborhood.
The decision came after Zheng and her attorney went before the review board and showed up with more than a dozen supporters, including next-door neighbor Matthew Eaton.

Re the Sept. 16 story, “Massage parlor mural rubs Hollywood the wrong way”:
Today’s current economic status could easily be described as bleak or bland. Even grim. Futures are not looking bright, and small businesses are struggling in the wake of the worst financial meltdown since the Depression. FDR understood that as a result of the Depression, the American people needed food and work, but he also recognized that they could use some distraction.

The massage parlor mural is not offensive, and neighbors aren’t complaining. Perhaps it should be up to the public to decide what is an eyesore or a “blight on the landscape.” At a time when funding for art programs in schools is drying up and the economy is barely hanging on, cities should be nurturing their artists and encouraging public artistic expression.
