Reporters and journalists claim to have sources on where LeBron James is going. Who are these sources? The janitor who usually over hear people’s conversations? The cook? Trainer? Ticket salesperson? Miss Cleo? Grounds keeper Willy? The Russian? The Prostitute? An intern? This situation brings out the best in people arguing over sources all over the media. I love it! I love it because they are just as clueless as you and me. They brag that they have the inside track. Then bet the house in Las Vegas. Put your money where your mouth is.

The district court’s reliance on Voyeur Dorm in concluding that Flava Works was not operating a business at the 27th Street residence is misguided. Just because the Tampa ordinance defining “adult entertainment establishments” limits its application to businesses does not mean the ordinance applies to all businesses. Furthermore, Voyeur Dorm did not hold that the Tampa residence was not a business, it merely held that the residence was not an adult business establishment (where there was no public offering of adult entertainment), which is a much narrower conclusion. We agree with Flava Works that an adult business is always a business. However, the opposite is not necessarily true. The vast majority of businesses are not adult businesses but are nevertheless prohibited within residential zones. As such, we decline to apply such an expansive reading of Voyeur Dorm and find that it does not address a prohibition against the operation of all businesses within a residential zone.

In 2007, the city’s code enforcement board posted a notice on Cocodorm’s door saying that operating an adult business in a residential zone was illegal, which set off an ongoing legal battle between the porn company and the city.
Flava Works Inc, Cocodorm’s parent company, sued the city in federal court and cited the case of Voyeur Dorm v. City of Tampa. A judge ruled in that case that Voyeur Dorm could operate in a residential zone because it was not offering adult entertainment services.

The city allows adult businesses only in industrial areas and requires city approval. However, Fay did not rule that the activities constituted an adult business, but merely a business. No matter what the situation, he argues that the city is right in claiming a business is being run in a residential zone.

A search of Miami News archives shows what he means. The Gaiety Club at 78th Street and Biscayne (hours 10:00 p.m. to 5:00 a.m.) was raided by the state attorney’s office for running a crooked poker game in which one fellow lost more than $38,000. Another Miami News item from 1958 tells of “stripteuse” Gina Marie’s upcoming appearance at the Gaiety.
By the mid-1970s, says Carbonell, the whole intersection was adult entertainment. Later came racial clashes. One by one, stores pulled out. Also hurting the shopping center was the decision to make NE 82nd Street one-way going west. Reversing that decades-old change would be the first step in revitalizing the area, he says.
